利用規約

本利用規約（以下「本規約」）は、「めんどくさい税」（以下「本アプリ」）の利用条件を定めるものです。ユーザーは本アプリをインストールまたは利用することにより、本規約に同意したものとみなされます。

1. サービス概要

本アプリは、先延ばしにしているタスクの「怠惰税」（精神的コスト）をエンターテインメント目的で算出するアプリケーションです。

2. 利用条件

• 本アプリは13歳以上の方を対象としています
• 本アプリの利用にはスマートフォンのカメラ機能へのアクセスが必要な場合があります
• インターネット接続は広告表示、SNSシェア機能、およびAI画像分析機能に必要です

3. 免責事項

3.1 計算結果について

• 本アプリが算出する「怠惰税」「実作業時間」等の数値は、あくまでエンターテインメント目的の概算値です
• 医学的、心理学的な正確性を保証するものではありません
• 計算結果に基づく行動について、開発者は一切の責任を負いません

3.2 AI画像分析について

• AI画像分析の結果（カテゴリ判定、規模推定）は参考情報であり、正確性を保証するものではありません
• AI分析はAnthropic社のAPIを使用しており、以下の場合に利用できないことがあります:
  • レート制限に達した場合（無料ユーザー: 1日3回まで。リワード広告の視聴により追加利用が可能です）
  • AI分析サーバーの障害・メンテナンス時
  • ネットワーク未接続時
  • コスト制御のためのサーキットブレーカー発動時
• AI分析が利用できない場合は、自動的に手動カテゴリ選択モードに切り替わります
• AI分析の一時的な利用不能は、サービスの障害や瑕疵には該当しません

3.3 サービスの提供

• 本アプリは現状有姿（as-is）で提供されます
• サービスの中断、変更、終了について、事前の通知なく行う場合があります
• アプリの不具合やデータの消失について、開発者は一切の責任を負いません

4. 禁止事項

ユーザーは以下の行為を行ってはなりません:

• 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル
• 本アプリを利用した違法行為
• 他者のプライバシーを侵害する写真の撮影・共有
• 本アプリの機能を悪用した嫌がらせ行為
• 不正な方法によるサービス利用制限の回避
• 違法な画像のアップロード（児童性的虐待画像（CSAM）、リベンジポルノ、その他法令で禁止されるコンテンツを含む）
• AI分析機能の不正利用（自動化ツール等を使用した大量リクエスト、APIへの不正アクセス）
• デバイス識別子の偽装・改ざん（レート制限やデバイスブロックの回避を目的とした行為）

5. AI分析機能の停止・制限

• 第4条の禁止事項に違反する画像（違法画像等）のアップロードが検出された場合、当該デバイスのAI分析機能を即座に停止します
• 停止措置は30日間のデバイスブロックとして適用されます
• 重大な違反（CSAM等）の場合、以下の対応を行う場合があります:
  • AI分析機能の永久停止
  • 法令に基づく関係当局（NCMEC等）への通報
  • 法的措置（刑事告発を含む）
• AI分析機能の停止中も、手動カテゴリ選択によるアプリの基本機能は利用可能です
• 停止措置に対する異議申し立ては、セクション12のお問い合わせ先までご連絡ください

6. 第三者サービスの利用

本アプリは以下の第三者サービスを利用しています:

• Anthropic社: AI画像分析（Claude 3 Haiku Vision）に使用。撮影画像がカテゴリ判定のために送信されます

各サービスの利用は、それぞれの利用規約・プライバシーポリシーにも準拠します。

7. 知的財産権

• 本アプリに関するすべての知的財産権は開発者に帰属します
• 「めんどくさい税」の名称、ロゴ、デザインは開発者の財産です
• ユーザーが生成した結果カードは、個人のSNS共有目的で自由に使用できます

8. 利用プランと課金

8.1 無料プラン（現行）

• 1日3回まで撮影・計算が可能です
• 3回を超えた利用はリワード広告の視聴により追加可能です（1日の上限あり）
• 一部画面にバナー広告が表示されます

8.2 有料プラン

• 今後、App Store / Google Playを通じた有料プラン（月額課金）を提供する場合があります
• 有料プランの内容・料金・課金条件等は、提供開始時にアプリ内でお知らせします
• 課金・解約・返金については、App Store / Google Playの規定に従います

9. ユーザーコンテンツ

• ユーザーが撮影した写真および生成された結果カードの権利はユーザーに帰属します
• SNSシェア時に結果カードに含まれるアプリロゴおよびハッシュタグの表示を削除・改変することはご遠慮ください

10. 規約の変更

本規約は、必要に応じて変更されることがあります。変更後の規約は、アプリ内での告知をもって効力を生じます。

11. 準拠法・管轄裁判所

本規約は日本法に準拠し、本規約に関する紛争は東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") govern the use of "Mendokusai Tax" ("the App"). By installing or using the App, you agree to these Terms.

1. Service Overview

The App calculates the "laziness tax" (mental cost) of procrastinated tasks for entertainment purposes.

2. Eligibility

• The App is intended for users aged 13 and older
• Camera access may be required for certain features
• Internet connection is required for advertisements, SNS sharing, and AI image analysis

3. Disclaimer

3.1 Calculation Results

• All figures such as "laziness tax" and "actual work time" are approximate values for entertainment purposes only
• No medical or psychological accuracy is guaranteed
• The developer assumes no responsibility for actions taken based on calculation results

3.2 AI Image Analysis

• AI image analysis results (category identification, scale estimation) are provided as reference information only; accuracy is not guaranteed
• AI analysis uses Anthropic's API and may be unavailable in the following cases:
  • Rate limit reached (free users: up to 3 times per day; additional uses available by watching rewarded ads)
  • AI analysis server outage or maintenance
  • No network connection
  • Circuit breaker activation for cost control
• When AI analysis is unavailable, the app automatically switches to manual category selection mode
• Temporary unavailability of AI analysis does not constitute a service defect or failure

3.3 Service Provision

• The App is provided "as-is"
• The service may be interrupted, modified, or terminated without prior notice
• The developer assumes no responsibility for bugs or data loss

4. Prohibited Activities

Users must not:

• Reverse engineer, decompile, or disassemble the App
• Engage in illegal activities using the App
• Photograph or share images that violate others' privacy
• Use the App's features for harassment
• Circumvent service usage restrictions through unauthorized means
• Upload illegal images (including child sexual abuse material (CSAM), revenge pornography, and other content prohibited by law)
• Abuse the AI analysis feature (mass automated requests, unauthorized API access, etc.)
• Forge or tamper with device identifiers (actions intended to circumvent rate limits or device blocks)

5. AI Analysis Suspension and Restrictions

• If uploads of prohibited images (illegal content, etc.) in violation of Section 4 are detected, the AI analysis feature will be immediately suspended for the associated device
• Suspension will be applied as a 30-day device block
• In cases of serious violations (such as CSAM), the following actions may be taken:
  • Permanent suspension of AI analysis
  • Reporting to relevant authorities (such as NCMEC) as required by law
  • Legal action (including criminal referral)
• During suspension, core app functionality remains available through manual category selection
• To appeal a suspension, please contact us at the address listed in Section 12

6. Third-Party Services

The App uses the following third-party services:

• Anthropic: Used for AI image analysis (Claude 3 Haiku Vision). Photos are sent for category identification

Use of each service is also subject to their respective terms and privacy policies.

7. Intellectual Property

• All intellectual property rights related to the App belong to the developer
• The name "Mendokusai Tax," logos, and designs are the developer's property
• Users may freely share generated result cards on personal social media

8. Plans & Billing

8.1 Free Plan (Current)

• Up to 3 captures/calculations per day
• Additional uses beyond 3 available by watching rewarded ads (subject to daily limits)
• Banner advertisements displayed on certain screens

8.2 Paid Plans

• Paid plans (monthly subscription) may be offered through App Store / Google Play in the future
• Details including features, pricing, and billing terms will be announced within the App when available
• Billing, cancellation, and refunds follow App Store / Google Play policies

9. User Content

• Rights to photos taken and result cards generated belong to the user
• Please do not remove or alter the app logo and hashtags displayed on result cards when sharing on SNS

10. Changes to Terms

These Terms may be updated as needed. Updated Terms take effect upon notification within the App.

11. Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
